Supreme Court Issues Major Ruling on Calculating Child Maintenance

(Digital Itla) Islamabad: The Supreme Court ruled that when determining maintenance for a minor child, reasonable child needs, the father's financial capacity, income, and social status must be evaluated. Lower court maintenance decisions will only be interfered with if they are demonstrably arbitrary, unreasonable, or contrary to the law.

A two-member bench comprising Justice Irfan Saadat Khan and Justice Aqeel Ahmed Abbasi dismissed petitioner Shaheen Nawaz's leave to appeal, upholding the Sindh High Court's decision. The appellate court had fixed monthly maintenance at Rs 30,000 with a 15% annual increase, taking into account the father's income, financial liabilities, and other dependents.
